Personal Information Collection Statement

This is a statement to inform you of your rights in relation to your personal information. 

For the purpose of this statement:

  • TTI Group Entity” means TAC and Techtronic Trading (Shanghai) Limited or any other person or entity directly, or indirectly through one or more intermediaries, controlling, controlled by, or under common control of TAC and Techtronic Trading (Shanghai) Limited; and

  • we”, “our”, “us” or “Company” means TAC and Techtronic Trading (Shanghai) Limited.

This statement shall be governed by, and construed in accordance with, the laws of Mongolia. If there is any inconsistency or conflict between the English and Mongolian versions of this statement, the Mongolian version shall prevail.

We would like to inform you of the following:

1. OVERVIEW

This statement sets out the purposes for which your personal data collected by us relating to Milwaukee Tool Mongolia website (https://www.milwaukeetool.mn/) will be used following collection, to whom it will be transferred and who is responsible for handling your data access or correction requests.

It is voluntary for you to provide the personal data requested by us. However, failure to receive the personal data marked with an asterisk (*) may result in the Company being unable to process your order or provide the service you request.

Please read this statement carefully before you provide any personal data to us.

2. COLLECTION OF YOUR PERSONAL DATA

Personal data held by us include your name, company name, telephone number, email address, correspondence address and billing details which is collected from you directly at the checkout page.

3. USE OF YOUR PERSONAL DATA

Personal data provided to us may be used and retained by us for:

  • checking stock availability;

  • providing you with information about the Company and our products and/or services; 

  • processing and completing your order;

  • processing and completing your gift/ souvenir redemption request;

  • verifying your payment details and status;

  • providing you with any service you request, including without limitation, aftersales service;

  • addressing your enquiries relating to or in connection with the Company, our products and/or services;

  • carrying out our obligations arising from contracts entered between you and us;

  • conducting customer survey;

  • conducting research and performing statistical analysis;

  • understanding your purchase preference;

  • notifying you of changes to our products and/or services that may affect you;

  • providing you details about our loyalty programmes;

  • processing your enrolment in and operation of our loyalty programmes (subject to your consent);

  • investigating complaints and suspicious transactions; 

  • preventing and detecting crimes;

  • satisfying our legal obligations; and

  • providing marketing materials to you, if you have given the necessary consent regarding direct marketing (please refer to section 4 below).

We will obtain your consent before using your personal data for other purposes.

Your personal data may be transferred to our banks, credit card issuers, payment gateways or payment service providers to verify your payment details and status.

Other professional service providers

Your personal data may be transferred to agents, contractors and other third-party service providers who provide telecommunications, collection, credit reference, security, financial or other professional services to us.

Data processor

Your personal data may be transferred to agents, contractors or other third-party service providers which provide data processing, data storage and data analytics services to the Company. In that case, the Company will adopt contractual and/or other means to ensure the data processors will take all practicable steps to (i) protect the personal data they hold against unauthorized or accidental access, processing, erasure, loss or use; and (ii) ensure that personal data will not be kept longer than necessary.

Parties and their representatives in a transaction

In the event the Company and/or any of the TTI Group Entities is involved in a merger, acquisition or due diligence exercise, your personal data may be transferred to a relevant outside party to the extent such data is reasonably required to decide on matters relating to the acquisition or merger. Examples of relevant outside party include the counterparty, their financial advisors, bankers and lawyers. Your personal data may also be transferred to new owners of the business.

Government departments, regulatory bodies and courts

Your personal data may be transferred to government departments, regulatory bodies and courts, to the extent permitted or required by applicable laws, rules, regulations, codes of practice or guidelines or pursuant to a court order.

 

We strive to ensure that your personal data to be transferred to third parties is adequate but not excessive in relation to that purpose.

4. DIRECT MARKETING

We intend to use the personal data set out in section 2 of this statement to send you marketing materials about, without limitation, our products, services, events, programmes, campaigns and news update. The dispatch of such direct marketing communications may be undertaken by third-party service providers.

In addition, we intend to provide the personal data set out in section 2 of this statement to other TTI Group Entities to send you marketing materials about, without limitation, updates on products, services, events, programmes and campaigns. Our provision of your personal data will not be for gain.

The direct marketing communications to you will generally be through electronic means (e-mail, SMS and/or other media whether now known or available in the future) and/or by direct mail.

You may opt out of receiving direct marketing communications from us at any time by sending your request to our Data Protection Officer using the contact information set forth at the end of this statement. We will then stop any further direct marketing communications from ourselves.

You may also at any time require us to cease to provide your personal data to any other person for use by that other person in direct marketing by sending your request to our Data Protection Officer using the contact information set forth at the end of this statement. We will comply with such request promptly and will notify in writing any person to whom the data has been so provided to cease to use the data in direct marketing.

The aforesaid requests can be made without charge.

Please note that you may continue to receive direct marketing communications for a short period after changing your preferences while we and/or other TTI Group Entities are updating our systems.

If we use your personal data in any direct marketing communications, you have the right to request that we provide you with the source of that personal data. We will provide you with the source of personal data unless it is impracticable or unreasonable to do so.

5. PROTECTION AND RETENTION OF YOUR PERSONAL DATA

We maintain appropriate technical and organizational measures to protect the personal data you provide to us from accidental or unlawful destruction, loss, alteration and unauthorized disclosure or access.

We will also take all practicable steps to erase your personal data if that is no longer required for the purpose for which the data is used, unless erasure is prohibited by law or is not in the public interest.

6. ACCESS TO AND CORRECTION OF YOUR PERSONAL DATA

You may request access to, and correction of, the personal data you have provided to us.

Should you wish to (i) check whether we hold any of your personal data, (ii) access your personal data held by us or (iii) require us to correct any personal data which is inaccurate, please send your request to our Data Protection Officer using the contact information provided at the end of this statement.
